Die Rechtsabteilung des Patentamtes verweigerte mit Beschluss (IR 867/2017-4) vorläufig den Schutz mit Wirksamkeit ab 20.4.2018 und forderte die Antragstellerin zur Äußerung bis 20.7.2018 auf. Die Antragstellerin äußerte sich in der ihr eingeräumten Frist nicht. Mit dem bekämpften Beschluss vom 16.8.2018 versagte das österreichische Patentamt den Schutz der Marke. Das Zeichen habe keine Unterscheidungskraft, es sei als allgemeiner Hinweis auf den Gegenstand der Waren und Dienstleistungen zu verstehen.

Dagegen richtet sich der Rekurs der Antragstellerin (den das Patentamt unter der Zahl IR 769/2018 registriert hat) aus dem Rekursgrund der unrichtigen rechtlichen Beurteilung mit dem Antrag, die Entscheidung der Rechtsabteilung dahingehend abzuändern, dass dem Patentamt die vollumfängliche Registrierung der Markenanmeldung aufgetragen werde.

Der Rekurs ist nicht berechtigt.

1. Im Fall der Versagung des Schutzes einer internationalen Marke durch das österreichische Patentamt hat der Antragsteller dieselben Rechtsmittel, die er hätte, wäre ein Eintragungsantrag im Schutzverweigerungsland gestellt worden, er kann dagegen also auch mit Rekurs nach § 37 MSchG vorgehen (Koppensteiner, Markenrecht 4 , 243 mwH; Ullrich in Kucsko/Schumacher, marken.schutz² § 2 Rz 101).

2. Nach § 4 Abs 1 Z 3 MSchG sind Zeichen von der Registrierung ausgeschlossen, die keine Unterscheidungskraft haben.

2.1. Ob einer Waren- oder Dienstleistungsbezeichnung Unterscheidungskraft zukommt, ist wie bei beschreibungsverdächtigen Zeichen anhand des Gesamteindrucks des Zeichens zu beurteilen (Koppensteiner, Markenrecht 4 82; RIS-Justiz RS0079038). Diese Eigenschaft kommt einer Marke zu, wenn sie unmittelbar als Hinweis auf die betriebliche Herkunft der fraglichen Waren oder Dienstleistungen wahrgenommen werden kann und so die Ursprungsidentität garantiert, sodass die maßgeblichen Verkehrskreise die Waren oder Dienstleistungen des Markeninhabers ohne Verwechslungsgefahr von denen anderer betrieblicher Herkunft unterscheiden können (C 108/97, Chiemsee; C 104/00 P, Companyline; C 398/08, Vorsprung durch Technik; C 104/01, Orange, Rz 62; EuG T 471/07, Tame it, Rz 15 mwN; RIS-Justiz RS0118396; 4 Ob 10/14w, Jimi Hendrix; 4 Ob 49/14f, My TAXI ) .

2.2. Fehlt die Unterscheidungskraft, so kann das Zeichen die Hauptfunktion der Marke als betrieblicher Herkunftshinweis nicht erfüllen (OBm 1/11, OXI-Effekt mwN; 4 Ob 38/06a, Shopping City mwN; RIS-Justiz RS0118396 [T7]). Da allein das Fehlen jeglicher Unterscheidungskraft ein Eintragungshindernis begründet, ist ein großzügiger Maßstab anzulegen; jede auch noch so geringe Unterscheidungskraft genügt, um das Schutzhindernis zu überwinden (OBm 3/12, Lounge.at, unter Hinweis auf BGH I ZB 22/11, Starsat; OBm 1/13, Malzmeister mwN; ähnlich RIS-Justiz RS0122383). Dies bedeutet jedoch nicht, dass eine Marke im Zweifel zuzulassen ist: Aus Gründen der Rechtssicherheit sind Marken, deren Benutzung vor Gericht mit Erfolg entgegengetreten werden könnte, nicht einzutragen (vgl C 104/01, Orange, Rz 58 und 59; C 64/02, Das Prinzip der Bequemlichkeit ).

2.3. Die Beurteilung, ob das Eintragungshindernis fehlender Unterscheidungskraft vorliegt, erfolgt anhand der konkret beanspruchten Waren und Dienstleistungen, für die das Zeichen angemeldet wurde (Asperger in Kucsko/Schumacher, marken.schutz² § 4 Rz 57). Die Eignung zur Erfüllung der Herkunftsfunktion muss nach objektiven Kriterien unter Berücksichtigung der Branchenüblichkeit geprüft werden (4 Ob 10/14w, Jimi Hendrix mwN). Abzustellen ist auf die Wahrnehmung der beteiligten Verkehrskreise, also auf den Handel und/oder den normal informierten und angemessen aufmerksamen und verständigen Durchschnittsverbraucher dieser Waren und Dienstleistungen (Asperger in Kucsko/Schumacher, marken.schutz 2 § 4 Rz 67 mwN der Rsp; Ingerl/Rohnke, MarkenG 3 § 8 Rz 73; C 104/01, Orange, Rz 46 und 63; RIS-Justiz RS0079038 [T1]; RIS Justiz RS0114366 [T5]).

2.4. Unterscheidungskraft haben bei Wortmarken grundsätzlich nur frei erfundene, keiner Sprache angehörende Phantasiewörter (im engeren Sinn) oder Zeichen, die zwar dem allgemeinen Sprachgebrauch angehören, jedoch mit der Ware, für die sie bestimmt sind, in keinem Zusammenhang stehen (Phantasiewörter im weiteren Sinn). Entscheidend ist, ob die Worte im Verkehr als Phantasiebezeichnungen aufgefasst werden (RIS-Justiz RS0066644).

2.5. Das in § 4 Abs 1 Z 3 MschG geregelte absolute Schutzhindernis der mangelnden Unterscheidungskraft ist zwingend von Art 3 Abs 1 lit b MarkenRL vorgegeben und deshalb richtlinienkonform auszulegen (vgl Hacker in Ströbele/Hacker/Thiering, MarkenG 12 , Einl Rn 24) . Die Richtlinienvorschrift entspricht Art 7 Abs 1 lit b GMV/UMV. Auch wenn es sich beim nationalen Markenrecht und dem Unionsmarkenrecht um voneinander unabhängige Rechtssysteme handelt, kann bei der Anwendung des auf der Markenrichtlinie beruhenden Markenschutzgesetzes auf Erkenntnisse zum Unionsmarkenrecht zurückgegriffen werden (C 215/14; Hacker in Ströbele/Hacker/Thiering aaO Einl Rn 36).

2.6. Ob Begriffe, die einer Fremdsprache entnommen sind, unterscheidungskräftig sind, hängt davon ab, ob ihre Kenntnis im Inland im Prioritätszeitpunkt so weit verbreitet war, dass der inländische Verkehr einen die Kennzeichnungsfunktion ausschließenden Sinngehalt erkennen konnte (4 Ob 7/05s = wbl 2005, 387, car care; 4 Ob 28/06f, Firekiller; 17 Ob 21/07y, Anti-Aging-Küche; 4 Ob 11/14t, EXPRESSGLASS ). Das kann selbst dann zutreffen, wenn die Bezeichnung in der Fremdsprache selbst nicht gebräuchlich ist (4 Ob 277/04w, Powerfood; 4 Ob 28/06f, Firekiller; 4 Ob 38/06a, Shopping City ). Englisch ist als wichtigste Handelssprache in Österreich die geläufigste Fremdsprache ( Koppensteiner, Markenrecht 4 84 mwN; RIS-Justiz RS0066456; 4 Ob 36/14v, selective/line ). Für fremdsprachige Wortzeichen gilt grundsätzlich nichts anderes als für deutschsprachige. Ob Begriffe, die einer Fremdsprache entnommen sind, unterscheidungskräftig sind, hängt davon ab, ob ihre Kenntnis im Inland im Prioritätszeitpunkt so weit verbreitet war, dass der inländische Verkehr einen die Kennzeichnungsfunktion ausschließenden Sinngehalt erkennen konnte (4 Ob 7/05s, Car Care; 4 Ob 28/06f, Firekiller; 17 Ob 21/07y, Anti-Aging-Küche; 4 Ob 11/14t, EXPRESSGLASS ). Das kann selbst dann zutreffen, wenn die Bezeichnung in der Fremdsprache nicht gebräuchlich ist (4 Ob 277/04w, Powerfood; 4 Ob 28/06f, Firekiller; 4 Ob 38/06a, Shopping City ).

2.7. „Black Friday“ („Schwarzer Freitag“) wird in den Vereinigten Staaten der Freitag nach Thanksgiving genannt. Da Thanksgiving immer auf den vierten Donnerstag im November fällt, gilt der darauffolgende Black Friday als Start in ein traditionelles Familienwochenende und als Beginn der Weihnachtseinkaufsaison.

Die erste bekannte Verwendung des Ausdrucks „Black Friday“ (in diesem Sinne) wurde durch Bonnie Taylor-Blake von der American Dialect Society recherchiert und eine Herkunft aus Philadelphia belegt: «JANUAR 1966 – „Black Friday“ ist der Name, den die Polizei von Philadelphia dem Freitag nach dem Erntedankfest gegeben hat, wobei dies kein Ausdruck von Begeisterung war. „Black Friday“ eröffnet offiziell die Weihnachtseinkaufszeit in der Innenstadt, und er bringt normalerweise massive Staus und überfüllte Bürgersteige, während die Geschäfte in der Innenstadt von Öffnung bis Schließung belagert werden.»

Während der Black Friday in den USA hauptsächlich vor Ort in den Geschäften und Filialen der Einzelhändler stattfindet, werden in Deutschland die meisten Rabatte online angeboten. Apple war 2006 das erste Unternehmen, das zum Black Friday mit Rabatten geworben hat.

2.8. Die beteiligten Verkehrskreise sind Interessenten oder Abnehmer für die beantragten Waren und Dienstleistungen, also die Fachkreise und die normal informierten, angemessen aufmerksamen und verständigen Durchschnittsverbraucher (RIS-Justiz RS0079038).

2.9. Nach neuerer Rechtsprechung des EuGH kommt es nicht mehr darauf an, ob das Wortzeichen bereits lexikalisch nachweisbar ist, sondern nur darauf, ob die Kombination insgesamt als sprachüblich und beschreibend anzusehen ist ( Ingerl/Rohnke, Markengesetz 3 § 8 Rz 127).

2.10. Nach der Rechtsprechung des BGH sind Wortmarken dann unterscheidungskräftig, wenn kein für die relvanten Waren/Dienstleistungen im Vordergrund stehender beschreibender Begriffsinhalt zugeordnet werden kann und es sich auch sonst nicht um ein gebräuchliches Wort der deutschen oder einer bekannten Fremdsprache handelt, das vom Verkehr, sei es auch nur wegen einer entsprechenden Verwendung in der Werbung, stets nur als solche und nicht als Unterscheidungsmittel verwendet wird. Je bekannter der beschreibende Begriffsinhalt einer Bezeichnung ist, desto eher wird der Verkehr ihn auch dann als solchen erfassen, wenn der Begriff ihm im Zusammenhang mit der Kennzeichnung einer Ware oder Dienstleistung entgegentritt ( Ingerl/Rohnke Markengesetz 3 § 8 Rz 128, BGH I ZB 96/05, Fussball WM 2006 ).

2.11. Im Zusammenhang mit den von der Antragstellerin beanspruchten Waren und Dienstleistungen kann zum Prioritätszeitpunkt nach der Lebenserfahrung ausgeschlossen werden, dass die beteiligten Verkehrskreise bei einer Verwendung der Bezeichnung Black Friday im Zusammenhang mit den einzelnen Waren oder Dienstleistungen einen Hinweis auf die betriebliche Herkunft der beanspruchten Waren oder Dienstleistungen sehen können. Die beteiligten Verkehrskreise werden im Begriff Black Friday den Tag des Shoppings Ende November jeden Jahres sehen, an welchem Händler, insbesondere auch im Internethandel, Rabattangebote veröffentlichen. Gerade der Handel im Internet ist bekanntermaßen nicht ausschließlich auf den österreichischen Markt beschränkt, und Bestellungen erfolgen sowohl bei Händlern im In- als auch im (angloamerikanischen) Ausland, sodass der Begriff den beteiligten Verkehrskreisen geläufig ist und sie damit den in der Vorweihnachtszeit stattfindenden Einkaufstag verbinden werden. Im Übrigen mangelt es nicht zuletzt umso mehr an der Unterscheidungskraft, als die Antragstellerin ihre Eintragung für ein äußerst breites Produktspektrum begehrt.

Da „Black Friday“ überwiegend beschreibend und/oder werbend ist und keine interpretationsbedürftige Aussage enthält – auch nicht bezogen auf die beantragten Klassen 09, 35, 41 – fehlt dem Zeichen die Unterscheidungskraft nach § 4 Abs 1 Z 3 MSchG (vgl auch C 92/10 P, Best Buy ).

Zum Argument, dass die Bedeutung von „Black Friday“ nicht allgemein bekannt ist und es größere Bevölkerungsgruppen gibt, die diese Bedeutung nicht kennen, ist darauf hinzuweisen, dass es genügt, wenn diese Kenntnis nur bei einem Teil des Verkehrskreises besteht (vgl 4 Ob 77/15z, AMARILLO mwN; 4 Ob 126/15f, Bukhara; OLG Wien 34 R 69/15i, BLUEBOARD; 34 R 27/14m, MAJA/CAYA; 34 R 147/15k, SKYR ).

2.12. Auf das weitere Argument der Antragstellerin, dass bereits diverse nationale Schutzzulassungen für die internationale Marke Black Friday erfolgt seien, ist nicht näher einzugehen, weil eine präjudizielle Bindung zu verneinen ist (4 Ob 11/14t, EXPRESSGLASS; RIS-Justiz RS0125405; C 37/03 P, BioID, Rz 47; C 39/08 und C 43/08, Schwabenpost und Volks.Handy, Rz 39; Asperger in Kucsko/Schumacher, marken.schutz² § 4 Rz 75 ff mwN; Koppensteiner, Markenrecht 4 70).

3. Da die Entscheidung keine Rechtsfragen von der Qualität des § 62 Abs 1 AußStrG aufwarf und über den Einzelfall hinaus nicht bedeutsam ist (RIS-Justiz RS0111880), ist der Revisionsrekurs nicht zulässig.

In diesem Fall hat das Rekursgericht nach § 59 Abs 2 AußStrG auszusprechen, ob der Wert des Entscheidungsgegenstands, der – wie hier – rein vermögensrechtlicher Natur ist, aber nicht in einem Geldbetrag besteht, EUR 30.000 übersteigt. Diese Voraussetzung ist angesichts der Bedeutung des Markenschutzes im Wirtschaftsleben gegeben.
